Terms of Service

1. Agreement

These Terms of Service govern your use of deteqttech.com and any related partner portal or evaluation-kit materials (collectively, the "Service") operated by DeteQt Pty Ltd ("the Company," "we," "us," or "our") (Level 5, 11 York Street, Sydney NSW 2000, Australia). By accessing or using the Service you accept these Terms. Nothing in these Terms limits any statutory rights you hold under the laws of your country of residence, including consumer protection laws applicable in Australia.

These Terms apply to the website and associated digital materials. Participation in field evaluation programs or hardware trials is governed by separate written evaluation agreements that take precedence over these Terms for matters specific to sensor operation, field data, and hardware custody.

2. Use of the Service

  • You must be of legal capacity in your jurisdiction or have appropriate organisational authorisation to accept these Terms on behalf of an entity.
  • You agree to use the Service only for its intended purpose: learning about DeteQt's quantum magnetic sensing technology and submitting evaluation inquiries.
  • You agree not to use the Service unlawfully, to interfere with its operation, or to attempt unauthorised access to any account, system, or network.
  • You may not scrape, reverse-engineer, copy, or redistribute the Service or its content except as permitted by mandatory law or with our prior written consent.

3. Intellectual Property

The Service, including all text, technical content, diagrams, software, and product specifications, is owned by the Company or its licensors and is protected by Australian copyright law and applicable international intellectual property law. The Company's NV-center sensing architecture, AI signal-processing methodology, and proprietary sensor calibration procedures are trade secrets and confidential information.

We grant you a limited, non-exclusive, non-transferable licence to access and use the Service for its intended purpose. Nothing in these Terms transfers ownership of any intellectual property to you.

4. User Content and Evaluation Submissions

When you submit an evaluation request form, you provide information describing your measurement challenge. You are responsible for the accuracy of that information. You grant the Company a limited licence to use, store, and process your submission for the purpose of assessing evaluation fit and communicating with you about your inquiry. We will not share the substance of your measurement challenge with third parties without your consent, except as required by law or as part of confidential discussions with our technical advisors.

5. Technical Information and Disclaimers

The performance figures, specifications, and pilot results cited on this Service are derived from the Company's internal field validation program and early-access pilots. They represent results under documented conditions and are not a warranty of performance in any specific deployment environment. Sensor performance in operational field or clinical settings depends on local magnetic interference, temperature, and installation factors outside our control.

The Service is provided on an "as is" and "as available" basis. We disclaim all implied warranties to the maximum extent permitted by applicable law. Mandatory consumer warranties under Australian Consumer Law and other applicable statutes are not affected by this disclaimer.

6. Limitation of Liability

To the maximum extent permitted by applicable law, the Company's total aggregate liability for any claim arising from or relating to the Service will not exceed AUD 200. This limitation does not apply to liability that cannot be excluded or limited under mandatory law, including liability under the Australian Consumer Law for goods and services with consumer guarantees.

7. Indemnification

You agree to indemnify and hold harmless the Company, its directors, officers, and employees from any claims, losses, damages, or costs (including reasonable legal costs) arising from your use of the Service in breach of these Terms, your violation of any applicable law, or your infringement of any third-party right.

8. Termination

We may suspend or terminate your access to the Service if you breach these Terms or engage in conduct that may harm the Company or other users. Provisions that by their nature should survive termination, including Sections 3, 5, 6, 7, and 9, will continue to apply.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of Australia, with the courts of New South Wales having jurisdiction over disputes arising under or in connection with them. Disputes are subject to the non-exclusive jurisdiction of the competent courts in Sydney, Australia, without prejudice to any mandatory consumer-protection rights applicable in your country of residence.

10. Changes and Contact

We may update these Terms from time to time. Material changes will be posted with a new "Last updated" date. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
